Liability Waiver:

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTIONS OF RISK AND INDEMNITY AGREEMENT. BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY!

Assumption of Risks & Release of Liability, Waiver of Claims and Indemnity:

I have completed the pre-exercise screening form and have truthfully answered all questions to the best of my ability. I am aware that participation could, in some circumstances, result in physical injury and have discussed my participation where applicable with my physician,

I, the undersigned, being aware of my own health and physical condition, and having knowledge that my participation in any exercise program may be injurious to my health, am voluntarily participating in physical activity with Centered Within Yoga. Having such knowledge, I hereby release Centered Within Yoga, their representatives, agents, and successors from liability for accidental injury or illness which I may incur as a result of participating in the said physical activity. I hereby assume all risks connected therewith and consent to participate in said program. I agree to disclose any physical limitations, disabilities, ailments, or impairments which may affect my ability to participate in said fitness program.

In consideration of the acceptance of participation in the program offered by Centered Within Yoga for myself, my heirs, executors, administrators and assigns, waive any claims to which I may become entitled  for injury or damage and WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Centered Within Yoga and it’s directors, officers, employees, agents and representatives (collectively ‘Centered Within Yoga’).

TO RELEASE CENTERED WITHIN YOGA, from any and all liability for any loss, damage, injury, or expense that I may suffer as a result of participating in the exercise programs offered  by Centered Within Yoga, due to any cause whatsoever. INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT ON THE PART OF ERIN CENTERED WITHIN YOGA.

I HAVE READ THIS AGREEMENT AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST CENTERED WITHIN YOGA.

Furthermore, in light of new circumstances regarding Covid-19, if you attend classes, workshops, private lessons, or any other ‘In-Person’ activities at Centered Within Yoga, you agree to the following additional Liability Waiver:

I acknowledge the contagious nature of the Coronavirus/COVID-19 and public health authorities recommend practicing physical distancing. I further acknowledge that Centered Within Yoga has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that Centered Within Yoga can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, studio staff, and other studio clients and their families. I voluntarily seek services provided by Centered Within Yoga and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending a Centered Within Yoga class.

I attest that: I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. I have not traveled internationally within the last 14 days. I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. I have not been diagnosed with Coronavirus/Covid-19. I am following all WorkSafe BC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19. I am attesting to these conditions each time I attend a class, workshop, private lesson, or any other services provided by Centered Within Yoga and all of its owners, partners, and employees.

I hereby release and agree to hold Centered Within Yoga harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the studio, or that may otherwise arise in any way in connection with any services received from Centered Within Yoga. I understand that this release discharges Centered Within Yoga from any liability or claim that I, my heirs, or any personal representatives may have against the studio with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Centered Within Yoga. This liability waiver and release extends to the studio together with all owners, partners, and employees.
